Student Challenges Play Up Stay Up Rule Claiming Sex Discrimination

According to a Kentucky sixth-grader’s lawsuit, a rule that limits the movement of boys (but not girls) basketball players between class-delineated teams violates equal protection laws and Title IX. Under the so-called “play up, stay up” rule, male students who play for a higher grade team can never play for a lower grade team, but female players can play up or down without any restrictions. “Specifically,” the lawsuit claims, “this rule unfairly subjects male basketball players to a harsh restriction on the number of grade levels at which they may play, but expressly exempts female basketball players from the restriction,” thus resulting in “gender-based discrimination against middle school male student-athletes....

Teacher Arrested For Classroom Fight Club

Some stories just leave you shaking your head – like news about Bill Cosby or anything recent involving Lindsay Lohan. And things take a special turn when the story involves teachers behaving badly or children getting hurt. After a series of events that combines both, a former substitute math teacher has been arrested and charged for essentially supervising a classroom “fight club.” It’s hard to see what a fight club has to do with math, but at least the teacher can use his skills to add up the amount of jail time he’s facing if convicted....

Texas Ag Daily Fantasy Is Illegal Gambling

Another day, another state outlawing daily fantasy gambling. This time it was Texas attorney general Ken Paxton, saying that DraftKings and FanDuel were taking bets in violation of state gambling laws. But Texas is the eighth state to come out against daily fantasy sites and one of the biggest daily fantasy markets, so how long will daily fantasy remain unregulated?...

Texas Supreme Court Justice Proudly Serves Jury Duty

Justice Jeff Brown believes in a loving God, the U.S. Constitution, and traditional Texas values. Which means he also doesn’t believe in making excuses to get out of jury duty. So when he received a summons to serve as a juror in a criminal case, Brown accepted the call. There was a possibility that he would be excused for a potential conflict because he serves on the Texas Supreme Court, but it wasn’t a problem because he serves on the civil panel....

Chicken And 2 Gorillas Commit Bicycle Theft

This crime story sounds amusing on first glance, and then, not so much. Decisions In Criminal Administrative Environmental And Contract Matters

People v. Turnage, No. C059887, involved an Equal Protection violation claim for the conviction of a defendant for maliciously placing a false or facsimile bomb with the intent to cause others to fear for their safety. In agreeing with the defendant, the Third District vacated the sentence in holding that a violation of section 148.1(d) is punishable only as a misdemeanor as defendant is similarly situated to someone convicted of the misdemeanor of placing a false WMD that did not cause sustained fear, and the legislative history of the latter provision shows that there is a reason to treat the two offenses differently for purposes of punishment....

If any story truly meets the definition of legally weird, this is it.
